Jean Mensa cannot escape cross-examination – Tsatsu argues in court

Lead Counsel for the petitioner in the ongoing presidential election petition hearing, Mr Tsatsu Tsikata has told the court that the chair of the 1st Respondent, Jean Mensa cannot skip cross-examination.

Mr Tsatsu argued that by filing a witness statement, the 1st Respondent has opened her up for cross examination.

“It is our respectful submission that by filing its witness statement the first respondent has clearly crossed the bridge as far as opening the witness up for cross-examination is concerned. That bridge has been crossed, the ship has already been sailed,” Tsatsu said in his argument to the bench.

Asked by one of the justices, Professor Nii Ashie Quartey, whether or not Jean Mensa cannot change her mind to testify, Tsatsu answered “The court has the power to disallow that change of mind.”

For his part, lawyer for the 2nd respondent Akoto Ampaw told the Supreme Court that the petitioner cannot compel the respondents to elect a witness to appear in the witness box.

During legal arguments on a move by the respondents’ decision not to testify in the case on Tuesday February 9, Mr Akoto Ampaw told the court “the petitioner cannot compel us to enter the witness box to adduce evidence.”

He added “The petitioner has adduced evidence and closed his case, we have taken the position that in our assessment they have not discharged the burden of proof and the burden of producing evidence and therefore, we will not give further evidence and the court will determine the case on the evidence before it.

“We are entitled not adduce any evidence, we are entitled not to call any witness.”

Lawyers for the 1st and 2nd respondents on Monday February 8 moved to close their cases in the ongoing election petition without their witnesses being cross-examined.

This was after Counsel for the petitioner Tsatsu Tsikata closed his case.

Mr Justin Amenuvor, lawyer for the 1st Respondent told the court that given the evidence of the petitioner’s witnesses who were crossed examined in the case, they do not want to lead any further evidence.

“Given the evidence of the petitioner’s witnesses under cross examination so far, of those witnesses, speaking for the 1st respondent, it is the 1st respondent’s case that we do not wish to lead any further evidence and therefore we are praying that this matter proceeds under Order 36 Rule 43 and CI 87 rule 3 (e) 5, we hereby and on that basis close our case.”

NDC has greater chance of winning 2024 polls with Mahama – Ephson

Veteran journalist and a pollster, Ben Ephson Junior says the National Democratic Congress (NDC) has greater advantage to win the 2024 Presidential election with John Mahama, considering the votes he garnered in the December 7, 2020 elections.

“I would be very surprised if the NDC picks somebody apart from Mahama,” the pollster told Captain Smart, host of the ‘Anɔpa Bɔfoɔ’ morning show on Angel 102.9 FM, Monday, February 8, 2021.

He added: “He got over 6.2 million votes. The main parties, NDC and NPP, are going to have headaches selecting a flagbearer. As things stand now Mahama is the foregone Candidate. He has a lot of advantages.

“Their main opponents also have a lot of disadvantages towards 2024. The only thing is whether they [NDC] will have a new running mate or not.”

The NDC will be racing for the Seat of Government in the 2024 general elections, despite the ongoing 2020 election petition hearing at the Supreme Court.

John Dramani Mahama, the 2020 Presidential Candidate for the NDC, based on expert views, is likely to lead the party again towards wresting power from the governing New Patriotic Party (NPP) in the 2024 general elections.

Answering the question of Mahama’s likelihood of losing to his contenders as Party leader, Mr. Ephson is positive that he will prevail over them. According him, John Mahama has a lot supporters on the ground so anyone who contents him will lose.

“The NPP is going to navigate a very tricky path in terms of new flagbearer, and they have a history of having problems whenever they elect a new flagbearer. For this reason a lot of people will like to contend him. If they do, they waste their monies, ” the pollster elaborated.

That said, during the party’s congress to select their Presidential Candidate for the 2020 elections, John Mahama garnered 178, 877 votes from 232 constituencies, representing 93.75% of total votes.

Other likely contenders include Professor Joshua Alabi, the party’s campaign manager in the 2020 elections, who prior to that contested for the leadership position and pulled 3, 835 votes representing 2.01%.

There is also some speculations in the media that Hannah Tetteh, former Member of Parliament (MP) for Awutu-Senya West Constituency and Minister for Foreign affairs under John Mahama, will be contesting for the position. She is now Special UN envoy to African Union.

Dr. Mahamed Ibn Chambas another diplomat serving as Special Representative of the Secretary-General and Head of the United Nations Office for West Africa and Sahel, is also conjectured to be part of candidates to contest in the race.

Others are Edward Korbly Doe Adjaho, former Speaker of Parliament; Kwame Awuah-Darko, former Chief Executive Officer (CEO) of Tema Oil Refinery (TOR); Horace Nii Ayi Ankrah, former Deputy Ghana Ambassador to China.

NDC behind the slow growth of Cape Coast,Do you agree

“The reason behind the slow growth of Cape Coast is NDC. They destroyed our once great town from 1982 onwards. Before they came, that Post Office, Courts, Ministries we’re functional. And there were jobs in Cape Coast…Ceredec, Mfantsiman, CMP, PWD, AESCHYLUS, SCC, Water Works, SHC, CMB, MMB, etc etc. Our Municipal Council was functioning, removing bins daily…then the revolution began to close down these institutions one after the other without paying benefits to anyone.

I was in UCC and keenly observed the antics of the revolutionaries, whose people in Cape Coast were not so bright but worked as agents to undermine the few successful people from our Town, who used to help us a lot: they destroyed the great life of Mr Doughan, the Deputy Regional Minister; Mr Joe Hayfron, Chairman of Dwarfs; they chased our former MP, Lawyer Brodie-Mends out of town; they chased William Amarteifio a quiet contributor out of the country; they shocking chased our main man, Col F G Bernasko out of town for years, together with J WS Degraft Johnson, former Vice President of Ghana…And many others, much to the applause of Cape Coasters. June 4 Movement wrote letters upon letters to PNDC to confiscate the properties of Ameen Sangari.

I saw the File with Leo Yankson of June 4th and reported it to Mr Walker who got them arrested. The letters were horrible. In all these, I saw so many Cape Coasters jubilation at the abuse of these people. NDC chased out Mr GEB Awuku out of the country and destroyed most of his businesses in Accra. NDCFUO took away Mr Kwesi Brew’s Golden Spoon Flour Factory. They attacked the Diamond Business of a great rich Cape Coast lady, Mrs Mary Rawlings (Mrs Adu Boahen).

They retired our leading men in the Top Hierarchy of Ghana’s Civil Service such as Robert Hinson and Ackah Yensu of State Insurance and I B Ashun, Principal Secretary of Ministry of Finance. All these people made quiet but significant contributions to our Town’s development.

Our rich men like Coleman Paitoo, Addison, W G Tandoh of Wescodye, Yankah of TOPP Farms, I K Quansah etc were all snuffed out. These days we don’t have such type of very rich people again except the ndcfuo. These people were always helping the Town. They supported our Afahye.

But we lost both our industries and great people; but Cape Coasters were only interested in the downfall of these successful people. I never stopped observing the ndc people terrorising and destroying our people and businesses. The point is, most Cape Coasters are not very successful but instead of being happy for our few successful people they rejoice when they see them demonised!

NDC destroyed, neglected and abandoned most institutions in Cape Coast including our time honoured sewage and sanitation system, employment avenues, hospitals and schools, Social Welfare, Parks & Gardens, Courts, Post Office etc.

Then they imposed their man on us as our Paramount Chief. He then went all out with his unnecessary political agenda…and opened a huge conflict between him and present President.

………………..
………………..

Let me tell you what we can do to help, below here.

We must send a Powerful Delegation of Cape Coasters to meet with the President at the Jubilee House and discuss these two things:

  1. To patch up the long running hostile conflict between President Nana Akuffo Addo and Omanhene Kwesi Atta. We must do it properly and help to reconcile their differences that developed in the disgraceful 2010 Afahye debacle. To me, our Chief must tone down on his NDC Politics considerably. Chiefs don’t normally show their true political colours so openly as he does.
  2. We must also have a plan to discuss our development from job creation, tourism, demolishing of Post Office (which should have been done when the ndc sold Ghana Telecom to Vodafone), rehabilitation of Cape Coast Elementary and Secondary Schools with their own Libraries, Fish Farming in the Fosu Lagoon, construction of Fishing Quay at ‘Abrofo Mpoano, Development of Sports, Rehabilitation of Cape Coast Central Hospital and attraction of Investors to establish viable businesses in our town that is located in the centre of Accra, Kumasi and Takoradi…etc etc.
We’ll add more items to the Agenda when the time approaches. So many Towns including ndc voting northerners have sent such delegation to the compassionate President and he has helped them with their requests. We are the only ones who haven’t gone to Jubilee House because we have NDC Leaders like the 2 MPs and the Oguaa Omanhene.

The Delegation to the President and Cabinet must include the following:

  • Mr Andrew Fiifi Simpson
  • Prof Philip Bondzi-Simpson
  • Mr Bernasko
  • Mr Victor Savage
  • Mr Ekow Sam
  • Mr Ato Amponsa-Dadzie
  • Mr Nana Butler
  • Mrs Christine Afrifa
  • Ms Christine Churcher
  • Rev Carl Sackeyfio
  • Legna and Cole Younger

The President knows most of these highly successful intelligent people from our Town and will listen to their pleas to let bygones be bygones. We can later have a good ceremony to pacify the gods to bring us peace and closure. Then our Delegation will let the NPP Government and President know our Development agenda. The Delegation can invite President Kufuor to the meeting and am sure he will join them because he spent most of his Weekends with Uncle Kojo Alata in Cape Coast.

We must ignore hateful people in town and focus on goodness and as we do so, goodies will return.

I can contribute by writing a short Piece of Essay about the contribution of Cape Coasters to the NPP!

I hope no one responds to my contribution here, please. We are not in a Debate but suggestion mode. Talk your own some and move on!”

Video] Election Petition: I never said Mahama won the 2020 elections – Aseidu Nketia confronts video evidence in SC

First witness for the petitioner in the 2020 Presidential Election Petition, John Asiedu Nketia, has stated in the Supreme Court that he never said the petitioner, John Dramani Mahama, won the 2020 Presidential Elections.

During cross-examination, the witness was confronted with video evidence where he was addressing an NDC press conference after the December 7 elections. The witness admitted to saying the NDC won majority of the seats in Parliament, but denied he declared John Mahama winner in any of the press conferences he addressed before and after the 1st Respondent Electoral Commission’s declaration of the presidential results on December 9.

According to Mr. Nketia, he only expressed expectations that the petitioner would win the elections based on his knowledge of the dynamics of elections in Ghana over the years.

“Every evidence was pointing at president Mahama’s victory and in fact, My Lords, permit me, in all the 7 parliamentary and presidential elections that have been held in this country before this one the presidential candidate and the political party which wins and controls parliament ends up winning the presidency”, he explained.

Counsel for the 2nd Respondent Akufo-Addo, Lawyer Akoto Ampaw insisted that the words of the witness during the press conferences suggested that the petitioner won the presidential elections.

“You claim in one of your statements that you won the elections in all the polling stations all over the country so I’m putting it to you that when you mad the statement that the petitioner had won the election, it presupposed you had the polling station pick sheets”, he queried.

But Mr. Nketia retorted, “My Lord, I indicated that I never said that the petitioner had won the elections”.

He also confirmed to the court that there was no mention of the petitioner winning the election in the petition.

Don’t lecture us, answer my questions – Akoto Ampaw to Aseidu Nketia

Lead Counsel for the 2nd Respondent in the 2020 Presidential Election Petition, Lawyer Akoto Ampaw, demanded during cross-examination that witness for the petitioner, Johnson Asiedu Nketiah, answered his questions without verbose explanations.

In the estimation of the Lawyer Akoto Ampaw, the witness’s explanations to some of the questions amounted to an attempting to lecture the court, rather than answering the questions he was being asked in the witness box.

The first witness of the petitioner was confronted in court Monday with video evidence of some NDC press conferences where he seemingly declared the petitioner a winner of the presidential elections.

Mr. Nketia admitted that he was indeed the one in the video and that “those are my words” but denied declaring John Mahama winner in the tapes played.

According to him, he only expressed his expectations that John Mahama would win the presidential elections on the face of the information available to him at the time.

Mr. Ampaw put it to him that he had by his words “implied that President Mahama had won the elections”.

Mr. Nketia attempted explaining how he arrived at his ‘expectation’.

“… My Lords permit me, in all the 7 parliamentary and presidential elections that have been held in this country before this one the presidential candidate and the political party which wins and controls parliament ends up winning the presidency so I…”

While at it, Mr. Ampaw interjected, demanding that he answers the questions being asked.

“Mr Asiedu Nketia, don’t lecture us, answer the questions, you can’t lecture us”, he said.
